Terms of Service

These Terms of Service (the “Terms”) are an agreement between you and Fever Sleeves LLC dba Little Columns (“Little Columns,” “we,” or “us”) for your use of the hosted Frisket service and related sites, software, and features (collectively, the “Service”). By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy.
1. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract. You must provide accurate account information, keep your credentials secure, and promptly tell us about suspected unauthorized use. You are responsible for activity under your account and for people you invite to your organization or projects.
2. The Service
Frisket helps people work with data and may use artificial intelligence and third-party services to process requests. Features and models may change, and generated results can be incomplete, inaccurate, or unsuitable. You are responsible for reviewing outputs and for decisions made from them. The Service is not legal, medical, financial, or other professional advice.
3. Your content
You retain ownership of content you submit, connect, or create. You grant us a worldwide, non-exclusive license to host, copy, transmit, process, display, modify, and create technical derivatives of that content as needed to provide, secure, support, analyze, develop, evaluate, and improve the Service. This may include automated analysis, human review, and model training, subject to applicable law and the Google-data limits described in our Privacy Policy. You represent that you have the rights and permissions needed for the content you provide.
4. Paid credits and billing
Paid credits are prepaid units for eligible Service usage. They have no cash value, are non-transferable, and are consumed at the prices displayed or otherwise disclosed when you use a paid feature. Payments are processed by Stripe. Except where required by law or where we correct a billing error, purchases and consumed credits are non-refundable. Credits do not expire unless an expiration is clearly disclosed before purchase. Taxes and third-party charges are your responsibility where applicable.
5. Acceptable use
You may not use the Service to break the law or another person’s rights; access systems or data without authorization; distribute malware; evade usage or security controls; interfere with the Service; misrepresent generated material; or create an unreasonable security, operational, or legal risk. You may not resell the Service unless we agree in writing.
6. Third-party services
The Service may connect to model providers, Google, Slack, Stripe, and other third parties. Their terms and privacy practices may apply to your use of those services. We are not responsible for third-party services, and their availability may affect Frisket features.
7. Intellectual property and feedback
We and our licensors own the Service, excluding your content. If you give us feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use it without restriction or compensation.
8. Suspension, termination, and deletion
You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms, risk to the Service or others, nonpayment, legal requirements, or discontinuation of the Service. Project deletion currently includes a seven-day recovery period. Account or data deletion can be requested at support@littlecolumns.com. Some information may remain as described in the Privacy Policy.
9. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, secure, or error-free. Nothing in these Terms limits rights that cannot legally be waived.
10. Limitation of liability
To the fullest extent permitted by law, Little Columns and its affiliates, personnel, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill. Our total liability arising from the Service will not exceed the greater of $100 or the amount you paid us for the Service during the 12 months before the event giving rise to the claim.
11. Indemnity
To the extent permitted by law, you will defend and indemnify us from third-party claims, losses, and expenses arising from your content, your unlawful or unauthorized use of the Service, or your violation of these Terms or another person’s rights.
12. Changes
We may update the Service and these Terms. If a change is material, we will provide notice through the Service, by email, or by another reasonable method. Continued use after the new effective date means you accept the updated Terms.
13. Governing law
New York law governs these Terms, without regard to conflict-of-law rules. Any dispute that is not subject to a legally required alternative forum must be brought in the state or federal courts located in New York, New York, and you consent to their jurisdiction. Mandatory consumer protections in your home jurisdiction continue to apply.
14. General
These Terms and the Privacy Policy are the entire agreement about the Service. If a provision is unenforceable, the rest remains effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, reorganization, sale, or transfer of the Service.
